Benaiah Lim

Counsel

Benaiah handles property and inheritance disputes. His key practice areas include Wills, Trusts, Probate and Estate Administration, as well as Mental Capacity disputes.

Clients have praised Benaiah for “working tirelessly” and have described engaging him as being “an absolute game-changer”.

Benaiah also accepts instructions on corporate, shareholder, and commercial disputes across a wide range of sectors. He regularly appears before the Singapore Courts and is experienced in arbitrations under the major rules, including SIAC, ICC, LCIA, UNCITRAL, SCMA and LMAA.

During his time at university, Benaiah was awarded the Maxwell Kohler Memorial Prize for being the top student in his penultimate year. He also won subject prizes for the Law of Obligations and Contract Law.

Outside of practice, Benaiah enjoys writing short stories and investigative pieces.

Property, Trusts, Probate & Administration, and Mental Capacity Disputes

  • Acted for the purchasers in the landmark decision of Li Jialin & Anor v Wingcrown Pte Ltd [2024] 2 SLR 372 to successfully challenge the developer’s forfeiture of a deposit in an abortive condominium sale. The Court of Appeal also set out a revised framework for the common law “True Deposit Test”.

  • Represented a joint beneficiary of an estate in obtaining an order for sale of a shophouse worth approximately S$4 million which parties to the litigation jointly inherited many years ago.

  • Acted for an applicant in a contested cross-deputyship application involving over S$3 million in assets.

  • Acted for a co-administrator of an estate with assets worth over S$2 million in resisting claims by the beneficiaries of alleged breaches of fiduciary duties.

  • Represented a successful businesswoman in defending claims in trust and unjust enrichment from an ex-lover of over S$8 million in real estate and movable property.

Commercial Disputes

  • Successfully obtained a worldwide freezing injunction in the Singapore High Court against defendants prohibiting the disposal of their assets worldwide up to the value of approximately S$2.8 million.

  • Successfully obtained an urgent order for sale of movable property worth over USD 4 million in the Singapore High Court arising from the applicant’s exercise of a contractual lien over the said goods.

  • Acted for bunker suppliers in Singapore High Court proceedings against a well-known international conglomerate to recover outstanding barging fees of over USD 28 million for breach of contract.

  • Acted for a claimant in SIAC arbitration proceedings against an investment company to recover the capital invested in the sum of approximately S$2.8 million on the ground that the investments were a sham.

  • Acted for a refrigeration company in a claim against the company’s director, his wife, and their companies for breach of fiduciary duties, dishonest assistance, and conspiracy to injure.
